Terms of Service

These terms are an agreement between you and HAHA Studios ("we", "us") covering your use of the GatherPop app, website, and guest pages (together, the "Service"). By using the Service you agree to them. If you do not agree, please do not use the Service.

1. What GatherPop is

GatherPop helps you plan a gathering. You choose a vibe, a headcount, and any dietary constraints, and the Service suggests a menu, drinks, streaming titles, a setlist, and a shopping list scaled to the number of people you are hosting. Everything the Service produces is a suggestion. You decide what to cook, pour, and serve.

2. Eligibility and age

You must be at least 18 years old, or the age of majority where you live, to create an account. The Service includes recipes for alcoholic drinks and is rated for adult audiences. Do not use the Service if you are below the legal drinking age in your jurisdiction.

3. Your account

You sign in through Apple or Google. You are responsible for activity that happens under your account and for keeping access to your sign-in method secure. Tell us promptly at [email protected] if you believe your account has been compromised. You may delete your account at any time from within the app.

4. Subscriptions and billing

GatherPop offers a free tier and a paid subscription. Paid subscriptions are sold and billed through the Apple App Store or Google Play, not by us directly. Subscriptions renew automatically until cancelled, and you cancel or manage them through your app store account settings — we cannot cancel or refund on your behalf. Refunds are governed by the policy of whichever store you purchased through. We may change pricing or the contents of a plan on reasonable notice; changes will not affect a billing period you have already paid for.

5. Food, allergies, and safety — please read this one

Recipes and ingredient lists surfaced by the Service come from third-party sources and from our own content. We do not verify them for accuracy, allergen content, or food safety. Nutrition figures are estimates and should not be relied on for medical or dietary decisions.

You are solely responsible for checking ingredients against the allergies, intolerances, religious requirements, and medical needs of everyone you serve, and for cooking, storing, and handling food safely. Dietary filters in the Service are a convenience and are not a guarantee. If someone at your table has a serious allergy, read the original recipe and the actual product labels.

6. Alcohol

GatherPop suggests drink recipes. We do not sell, ship, or deliver alcohol, and we are not a licensed alcohol retailer. Drink responsibly, serve responsibly, never serve anyone under the legal drinking age, and follow all laws where you live. Batch quantities produced by the Service are estimates based on your headcount and are not a recommendation about how much any individual should drink.

7. Affiliate links

Decor and tableware suggestions may include affiliate links. If you buy something through one, we may earn a commission at no additional cost to you. As an Amazon Associate I earn from qualifying purchases. Commissions never influence which items we suggest. Full detail is on our affiliate disclosure page.

8. Third-party content and services

The Service displays content from third parties, including recipe data and links to the original publisher's instructions, film and television metadata and artwork, and streaming availability information. That content belongs to its owners and is subject to their terms. We credit sources where required and link back to the original. Streaming availability changes constantly and may be out of date or wrong; we do not guarantee that a title is available on your services, in your country, or at the price shown.

Optional integrations such as Apple Music and Pinterest are governed by those companies' own terms in addition to these. Connecting them is your choice, and you can disconnect at any time.

9. Content you create, and guest pages

You keep ownership of the content you create — your nights, notes, lists, and guest details. You grant us a limited licence to store, process, and display that content for the purpose of operating the Service for you, including rendering a guest page when you choose to share one.

A guest link is a public, unlisted URL. Anyone who has the link can view the page, so share it only with people you intend to invite, and do not put sensitive information on it. You are responsible for the content of a night you share and for having permission to include other people's names or dietary information. You can revoke a guest link at any time.

10. Acceptable use

You agree not to:

Use the Service for anything unlawful, or to harass, threaten, or harm anyone.
Scrape, bulk-download, or systematically extract content or data from the Service.
Reverse engineer, decompile, or attempt to derive our source code, except where that restriction is prohibited by law.
Interfere with, overload, or attempt to gain unauthorised access to our systems.
Resell, sublicense, or commercially redistribute the Service or its content.
Submit content to guest pages or song requests that is abusive, obscene, or infringing.

We may suspend or terminate accounts that breach these terms.

11. Our intellectual property

The GatherPop name, logo, app, website, our curated drink collection, our generated imagery, and our theme and setlist output are owned by HAHA Studios and protected by intellectual property law. You may use them only as part of using the Service normally.

12. Availability and changes

We are still building GatherPop, and features described on this site may change, be delayed, or not ship at all. We may modify, suspend, or discontinue any part of the Service. We will give reasonable notice before discontinuing a paid feature, and will not charge you for a period in which a paid feature is unavailable.

13. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any suggestion it produces will suit your event, your guests, or your taste.

14. Limitation of liability

To the fullest extent permitted by law, HAHA Studios will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these terms limits liability for fraud, death, or personal injury caused by negligence where the law does not permit that limitation.

15. Indemnity

You agree to indemnify and hold harmless HAHA Studios from claims arising out of your misuse of the Service, your breach of these terms, or content you share through a guest page.

16. Governing law

These terms are governed by the laws of the State of Oregon, USA, without regard to its conflict-of-law rules. Disputes will be brought in the state or federal courts located in Multnomah County, Oregon, and you and we consent to their jurisdiction — except that either of us may seek injunctive relief in any competent court, and nothing here removes a consumer right you have under the mandatory law of your own country.

17. Changes to these terms

We will update this page when the terms change and revise the date at the top. For material changes we will give notice in the app or by email. Continuing to use the Service after a change takes effect means you accept the revised terms.
